By providing your phone number, you consent to receive SMS messages from Radiant Signing Services related to your appointment and our services, including Loan Signing, Notary Work, and Apostille Processing. Privacy and Data Sharing
Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Any third-party services referenced elsewhere in these Terms (such as our client management system) are used solely for service delivery and are not used for marketing purposes.
Loan Signing Services Terms & Conditions
1. Scope of Services
Radiant Signing Services (RSS) provides mobile notary and loan signing services as an independent contractor. RSS facilitates the execution of loan documents and returns documents to the contracting party. RSS is not a lender, title company, escrow officer, or legal advisor.
2. No Legal, Financial, or Advisory Services
Radiant Signing Services ("RSS") facilitates the execution of loan documents and may provide general, non-advisory descriptions of document purpose and structure as part of the signing process.
Client acknowledges and agrees that:
- RSS may identify documents, indicate where key information is located, and provide factual, standardized descriptions commonly associated with loan signing services; however
- RSS does not provide legal, financial, tax, or advisory services of any kind
- RSS does not interpret the meaning, enforceability, or legal effect of any document
- RSS does not answer questions requiring professional judgment, opinion, or analysis
Borrowers with questions regarding loan terms, obligations, interest rates, or legal consequences must direct such questions to their lender, escrow officer, or licensed professional.
Any decision by a borrower to sign, delay, or refuse documents is made independently and without reliance on RSS.
3. Independent Contractor Status
RSS operates solely as an independent contractor and is not an employee or agent of any title company, lender, or signing service. RSS is not responsible for loan approval, funding, underwriting, or closing outcomes.
4. Client and Borrower Responsibilities
The Client is responsible for providing complete and accurate documents. Radiant Signing Services ("RSS") will make reasonable efforts to contact the borrower(s) to schedule the signing; however, borrower availability and participation are outside of RSS's control.
In the event a signing is canceled, postponed, or not completed due to borrower unavailability, refusal to sign, or other circumstances outside of RSS's control, a reasonable fee may be charged to cover services already performed, including document printing, travel, and time reserved.
Any such fees will be fair, customary, and communicated in advance when possible, in accordance with standard industry practices.
5. Fees and Payment
All fees are due as agreed prior to or upon completion of services. Fees are based on time, travel, printing, and professional services provided.
In the event a signing is canceled, postponed, or not completed, fees will be adjusted based on the level of services already performed. This may include reasonable charges for document printing, travel, and time reserved.
Radiant Signing Services ("RSS") will make reasonable efforts to work with clients in good faith, and any partial refunds or fee adjustments may be provided at RSS's discretion, taking into account the specific circumstances of the order and standard industry practices.
6. Printing, Scanbacks, and Document Handling
RSS is not responsible for errors in documents provided. Clients are responsible for ensuring documents are complete and accurate. Additional fees may apply for reprocessing.
7. Cancellations and No-Shows
In the event a signing is canceled after document preparation or within 24 hours of the scheduled appointment, reasonable fees may apply based on services already performed and will be mutually agreed upon by both parties.
In situations involving borrower no-shows or refusal to sign, any applicable fees will be determined reasonably based on the services completed and consistent with standard industry practices.
8. Re-Sign and Corrections
If a re-sign is required due to client or lender error, a new fee applies. If due to RSS error, corrections will be made within a reasonable scope and at no additional cost.
9. Shipping and Delivery
RSS is not responsible for delays, loss, or damage caused by third-party carriers. The client assumes these risks once documents are transferred.
10. Funding and Recording Disclaimer
RSS does not guarantee loan funding, recording, or acceptance of documents. RSS is not liable for delays or failures related to funding or recording.
11. Limitation of Liability
To the fullest extent permitted by California law, RSS liability is limited to the amount paid. RSS is not responsible for indirect or consequential damages.
12. Indemnification
Client agrees to indemnify and hold harmless RSS from any claims arising from document errors, borrower actions, or lender decisions.
13. Dispute Resolution
In the event of any dispute, claim, or controversy arising out of or relating to the services provided by Radiant Signing Services ("RSS"), the parties agree to first attempt to resolve the matter in good faith through informal discussions.
If the dispute cannot be resolved informally, the parties agree to submit the matter to non-binding mediation in Sacramento County, California, prior to initiating any legal action. Each party shall bear its own costs and expenses associated with mediation.
14. Acceptance
Engagement of services constitutes acceptance of these Terms and Conditions.
Notary Work: Terms & Conditions
By scheduling an appointment with Radiant Signing Services ("RSS"), the Client agrees to the following Terms & Conditions:
1. Scope of Services
RSS provides mobile notary and loan signing services, travel services, time based professional services, and administrative support.
California notarial fees are regulated by law and are separate from service, travel, convenience, or other fees.
RSS does not provide legal advice, legal document review, or guidance regarding the legal sufficiency of any document.
2. Notarial Fees (California Government Code §8211)
Clients may be charged the full appointment fee in advance, including anticipated notarial fees. The statutory notarial fee of $15 per notarized signature is earned only when a notarization is successfully completed. If a notarization is not completed, the prepaid notarial fee will be refunded.
All other fees, including travel, service, booking, after-hours, facility access, and administrative fees, are non-refundable unless otherwise stated in writing.
3. Payment Terms
Payment is due in full at the time of booking unless otherwise agreed in writing.
Appointments are not confirmed until payment is received.
Payment constitutes acceptance of these Terms & Conditions.
4. Cancellation & Refund Policy
A. Cancellations more than 24 hours before appointment time
Client will receive a 50% refund of the total invoice, minus any completed work, document review, or preparation already performed.
B. Cancellations within 24 hours of the appointment time
Client will receive a refund of the statutory notarial fee only (if prepaid). All other fees (including but not limited to travel, service, booking, facility access, after hours, and administrative fees) are non-refundable.
5. Non-Completion of Notarization
No refunds are issued if the notarization cannot be completed due to Client-related issues, including but not limited to:
- No valid, acceptable ID
- Signer unwilling or unable to sign
- Signer not present
- Signer incoherent, medically unable, or unable or unwilling to sign for any reason
- Facility refusal (hospital, jail, rehab, etc.)
- Incorrect or incomplete documents
- Missing witnesses (if required)
The statutory notarial fee will be refunded, but all other fees remain non-refundable.
6. Travel, Service, and Booking Fees
These fees compensate RSS for time, travel, scheduling, preparation, training, supplies, business costs, administrative work, and appointment blocking.
They are incurred upon booking and are non-refundable unless otherwise stated.
7. Jail, Hospital, Nursing Home, and High-Risk Appointments
Due to high no-show and access denial rates:
- Full payment is required upfront
- No refunds if the signer is unavailable, moved, asleep, sedated, or access is denied
The statutory notarial fee will be refunded only if no notarization occurs.
8. Late Arrivals & No-Shows
If the Client or signer is more than 20 minutes late, the appointment may be canceled at RSS's discretion.
No refunds will be issued except the statutory notarial fee.
9. Document Accuracy & Acceptance
RSS is not responsible for the content, legality, accuracy, or completeness of any document presented for notarization.
RSS does not guarantee that any notarized document will be accepted by any third party, agency, institution, or jurisdiction.
RSS does not provide legal advice.
10. Limitation of Liability
RSS's total liability for any claim arising out of services provided shall be strictly limited to the total amount paid by the Client for that specific appointment.
RSS shall not be liable for indirect, consequential, incidental, or punitive damages.
11. Indemnification
The Client agrees to indemnify, defend, and hold harmless RSS and its representatives from any claims, losses, damages, liabilities, or expenses arising from:
- The content, legality, or use of any documents
- Rejection of documents by any third party
- Actions taken by the Client or signer
- Misrepresentations made by the Client or signer
- Any consequences resulting from the notarization or lack thereof
This indemnification survives completion of services.
12. Mediation Clause
In the event of any dispute, the Client agrees to participate in good faith mediation in Sacramento County, California, prior to initiating any legal action.
Each party is responsible for its own mediation costs.
13. Acceptance of Terms
By scheduling an appointment, paying an invoice, or engaging RSS services, the Client acknowledges and agrees to these Terms & Conditions.
Apostille Processing Services Terms & Conditions
1. Scope of Services
Radiant Signing Services (RSS) provides apostille facilitation, document courier, document authentication support, notarial services, and administrative services. RSS acts solely as a facilitator between Client and government agencies.
2. No Legal Advice
RSS is not a law firm and does not provide legal, immigration, tax, or international compliance advice. Client is responsible for determining document requirements.
3. Client Responsibility for Document Accuracy
Client is solely responsible for ensuring documents are complete, accurate, properly executed, notarized, and eligible for apostille processing.
4. Government Agency Requirements
RSS cannot guarantee approval, issuance of an apostille, authentication, certification, or acceptance by any agency.
5. Processing Time Disclaimer
All turnaround times are estimates only. RSS does not guarantee completion by any specific date.
6. Fees and Payment
All fees are due in advance unless otherwise agreed in writing. Payment constitutes acceptance of these Terms.
7. Non-Refundable Fees
Once work has commenced, administrative, courier, travel, filing, shipping, and service fees are earned and non-refundable.
8. Rejected Documents
RSS is not responsible for government rejection of documents and is not liable for resulting delays, costs, or consequences.
9. Shipping and Courier Disclaimer
RSS is not responsible for carrier delays, loss, damage, or misdelivery after documents are entrusted to a third-party carrier.
10. International Use Disclaimer
RSS does not guarantee acceptance of apostilled documents by foreign governments, courts, embassies, consulates, educational institutions, or private entities.
11. Force Majeure
RSS is not liable for delays caused by circumstances beyond its control, including government closures, natural disasters, labor disputes, or system outages.
12. Limitation of Liability
To the fullest extent permitted by California law, RSS liability shall not exceed the amount paid for the specific order giving rise to the claim.
13. Indemnification
Client agrees to defend, indemnify, and hold harmless RSS from claims arising out of client documents, instructions, inaccuracies, third-party actions, or rejection of documents.
14. Abandoned Orders
Orders inactive for more than 30 days may be closed without refund. Return shipping costs remain Client's responsibility.
15. Attorney Fees
To the fullest extent permitted by law, RSS may recover reasonable attorney fees and costs incurred enforcing these Terms.
16. Mediation and Venue
The parties agree to attempt mediation in Sacramento County, California, before litigation.
17. Entire Agreement
These Terms constitute the entire agreement regarding apostille services.
18. Urgent Deadline Disclaimer
Client acknowledges RSS cannot guarantee completion by any deadline, including immigration, visa, court, educational, business, or travel deadlines.
19. Acceptance
By scheduling services, submitting documents, paying an invoice, or engaging RSS, Client agrees to these Terms and Conditions.
